1. Agreement to Terms

This website is operated by Tech4Tails. Throughout the site, the terms “we”, “us” and “our” refer to Tech4Tails. By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and policies referenced herein. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, or merchants.

2. Australian & NZ Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) and the New Zealand Consumer Guarantees Act (CGA). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. These Terms are in addition to, and do not override, your statutory rights.

3. Importer of Record & Regulatory Compliance

  • Purchaser as Importer: By placing an order with Tech4Tails, you (the "Purchaser") acknowledge and agree that you are the Importer of Record for all goods ordered. 

  •  It is the Purchaser’s sole responsibility to ensure that the importation and use of the goods comply with all local, state, and federal regulations in their jurisdiction.

  • By completing your purchase, you waive any claim against Tech4Tails regarding the regulatory status, certification, or local compliance of the product.

4. Shipping

  • Delivery Estimates: Shipping timeframes (e.g., 4–7 business days) are estimates only. We are not liable for any loss or damage resulting from delivery delays caused by couriers, customs processing, or force majeure events.

5. Product Use & Safety Disclaimer

  • Training Aid Only: Our products are intended solely as behavioural training aids. They are not a substitute for professional veterinary advice or animal behavioural therapy.

  • Assumption of Risk: You assume all risk associated with animal training. Every dog reacts differently to ultrasonic and vibration stimuli. Tech4Tails is not liable for any injury, loss, or damage (including death) to any person or animal arising from the use or misuse of our products.

  • Prohibited Use: Products must not be used on dogs that are under 6 months of age, suffer from heart conditions, or display aggressive/protective tendencies.

  • Fitment: It is the Purchaser's responsibility to ensure the collar is fitted correctly. Tech4Tails is not liable for skin irritations or injuries resulting from prolonged wear or incorrect fitting.

6. 60-Day "Fair Go" & Warranty Policies

  • Performance Guarantee: Our 60-Day Fair Go Policy is a performance-based guarantee, not a "change of mind" policy. Refunds are issued at our sole discretion and require the Purchaser to have followed the Training Optimisation Plan for a minimum of 21 days.

  • 12-Month Warranty: This warranty is strictly limited to manufacturing faults under normal use. It does not cover physical damage (e.g., chew marks), water damage beyond the device's IP rating, or "wear and tear." Warranty replacements are limited to one per original purchase.

7. Limitation of Liability & Indemnification

  • Indemnification: You agree to indemnify, defend, and hold harmless Tech4Tails and our directors, officers and employees from any claim, demand, loss, or expense (including reasonable legal fees) arising out of:

    1. Your status as the Importer of Record.

    2. Your breach of these Terms or your violation of any law.

    3. Any injury or damage caused to or by your pet while using our products.

  • Liability Cap: In no case shall Tech4Tails' total liability exceed the purchase price of the specific product that gave rise to the claim.

8. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the law.

10. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be deemed severed from these Terms and the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
